It just occurred to me when I posted this song at the "What Are You Listening To?" thread...

Oskar Joost Tanz Orchester -- Blindekuh (1936)

that it sounds a bit like this...

Jan Garber and his Orchestra -- Under The Moon (1927)

Amazing thread, spent the best part of an enjoyable hour or three comparing the similarities. What does surprise me though is, the apparent lack of litigation for plagiarising the work of another. There was a a famous case when, after the split of The Beatles, George Harrison was successfully sued by the management of The Chiffons, for claiming originality of "My Sweet Lord." Apparently it was a remix of The Chiffons number: "He's So Fine." So, how did Christina Aguilera get away with"Candyman?" Is it The Boogie Woogie Bugle Boy, or what?
Then again, there a young lady, name of Eliza Doolittle, who recorded: "Pack It Up." Is that not George Asaf's Pack Up Your Troubles?

Have to admit though, I do have a grudging like of the copied versions.

And did you know that Chuck Berry covered his own song? First it was known as Schooldays. Then it became No Particular Place To Go. At least Chuck couldn't sue himself for intellectual copyright infringement.

And did you know that Chuck Berry covered his own song? First it was known as Schooldays. Then it became No Particular Place To Go. At least Chuck couldn't sue himself for intellectual copyright infringement.

Fantasy Records sued John Fogerty for copyright infringement claiming that “The Old Man Down the Road” was “Run Through the Jungle” with different lyrics.

John Fogerty was sued for copying John Fogerty.

John Fogerty was sued for copying John Fogerty.

This was a very interesting case, on several levels. First, Fogerty successfully defended himself against the copyright infringement claim, even bringing his guitar into the witness stand to show the differences in how he composed the two songs. The court confirmed that John Fogerty could not be sued for writing a song that merely sounded like it was written by John Fogerty, as long as it was truly a different song. This was a landmark decision, as many artists do not own the publishing rights to their original compositions.

The second part of that was the suit by Fogerty to seek attorney's fees for defending himself. The lower courts ruled that he had to show the case was frivolous and without merit, and it wasn't; therefore, he was not entitled to attorney's fees. Fogerty appealed all the way to the U.S. Supreme Court who overturned the lower court, making a sweeping statement about the intent of the Copyright Act of 1976. The USSC ruled that the intent of the Act was to encourage and reward the publication of creative work, and to that end, the ability to defend a copyright infringement claim was just as important as the ability to claim the infringement in the first place. In short, the "frivolous" part is not a requirement to award the defendant attorney's fees.

Yeah, I know. Technically, "the same song," but a direct translation of the French is, at least in my opinion, more substantial.

Along those same lines, the French song Les Yeux Ouverts is sung to the tune of Dream A Little Dream Of Me. It's not an exact translation, though I don't know how close it's supposed to be. The former was used in the movie French Kiss.

Here's the French version:

And the English version of the original by the same artist:

On a side note...the French version is the first song to which I danced with my wife.

1.「はじめてのチュウ」, the opening of キテレツ大百科 / Kiteretsu Daihyakka:

2.「Hajimete no chuu」cover by SCANDAL:

Also interesting to note is that glow sticks were distributed to the audience. And no one is throwing them at the stage.

3. "My First Kiss" by Platina Jazz from their second album of Japan anime covers:

4. Bonus track. Original seiyuu (voice actor) singing 「はじめてのチュウ」in character and as himself:

I love how everyone sings along. The audience reaction when he sings in his natural voice is priceless.
