that's the only explanation. BK has given the best analysis of union labels so far on here, and he seems to think they aren't very reliable as ways to date a garment.
That's not a '36 or '39 ACWA union tag, it's a UGWA tag. The tags placed in UGWA made garments were virtually unchanged for many, many years. One thing you can use to date garments is look and see whether there is an AFL-CIO marking versus an AFL or CIO marking.
Yeah, that union label is found everywhere from the 1920s to the 1970s. The most recently made garment i've seen with that very label is a pair of 1970s ladies bellbottom jeans.
