"Based on the posts here, I do not believe that this is ebay's most paranoid vendor." This is indeed a statement of opinion since you put those wonderful little words "I do not believe" in the statement but you did not provide any evidence of your own to support your opinion.
"I think Joe...
Actually it is you who seems to lack the knowledge on the subject.
Stating the basis for the opinion makes it a "statement of fact." It does NOT make the statement true.
The whole basis of defamation determination is whether or not a "statement of fact" is indeed true.
Opinions don't have proof. If you provide "evidence" to support your "opinion" then you are stating a fact and not an opinion.
I know it sounds like splitting hairs but that's the way it is.
Nothing a lawyer would get upset about. There aren't any laws that say a person can't be a jerk if he wants to.
Calling someone "eBay's Most Paranoid Vendor" on a public forum could definately come under libel or slander laws though.
No question the seller could use some public relations...

The seller in this case has done nothing wrong but has had his/her...
Yeah, that keeps coming up but is not at all applicable in this case. The product was shipped, received and was what the seller described in the listing. A Scala marked XL.
So far, this thread has served to provide the seller with evidence that he/she did indeed ship the product that was...
I pop mine brim up and place them crown up on a gridded plastic drying rack with a stretcher in place. My stetchers are the old wooden ones and heavy enough that if I put the hats upside down it affects the crease.
For western hats and others that cannot be popped brim up I place the...
I haven't run into it with Power Sellers but I have with several store owners. I see no indication that the seller in this case is a Power Seller. I'm suspicious anyway of sellers with more than 5,000 feedbacks and less than 99% positive.
I've just never thought of eBay as a place to establish a relationship. Buyer pays, seller ships, end of relationship.
Sellers with eBay stores or with hundreds of items listed at a time are often quite terse in their communications. That is surely not the best case for buyers but is easily...
